Who is Required to Get a Tax Audit Under Section 44AB?

  1. Businesses with Higher Turnover:
    • Any person carrying on a business is required to have their accounts audited if total sales, turnover, or gross receipts exceed ₹1 crore in any previous year.
    • Exception: For businesses where:
      • Cash receipts (including sales) are ≤ 5% of total receipts.
      • Cash payments are ≤ 5% of total payments.
      • The turnover limit for audit increases to ₹10 crore.
  2. Professionals with Significant Receipts:
    • A professional must undergo a tax audit if their gross receipts exceed ₹50 lakh in a financial year.
  3. Presumptive Taxation Schemes:
    • Taxpayers declaring income under Sections 44AE, 44BB, or 44BBB who report income below the presumptive levels are required to conduct a tax audit.
    • Professionals or businesses under Sections 44ADA or 44AD who claim lower income than deemed profits must also comply if their income exceeds the basic exemption limit.
  4. Other Circumstances:
    • Businesses ineligible for presumptive taxation under Section 44AD due to opting out are subject to audit if their income exceeds the basic exemption limit.

Audit Report and Filing

  • The audit must be conducted by a qualified accountant as defined under Section 288.
  • The audit report is furnished using prescribed forms:
    • Form 3CA: For taxpayers already required to conduct an audit under any other law.
    • Form 3CB: For others not covered under the above.
    • Form 3CD: Statement of particulars relevant to the tax audit.

The “specified date” for furnishing the tax audit report is 30th September of the subsequent year of the relevant Financial Year


Exemptions and Special Provisions

  • Tax audits are not required for taxpayers declaring income under Section 44AD or 44ADA if they meet specific conditions (e.g., reporting income as per the presumptive scheme).
  • Income from shipping or air transport under Sections 44B or 44BBA is excluded from the purview of this section.

Significance of Compliance

Non-compliance with Section 44AB attracts a penalty under Section 271B, which can be up to 0.5% of turnover, sales, or receipts, subject to a maximum of ₹1.5 lakh. This underscores the importance of timely and accurate audits.
